MONTHLY CONSIGNMENT OPTIONS

WALL SPACE    • 48” wide = $50    • 24” wide = $30

SHELF SPACE    • 36” wide = $40  • 18” wide = $25

Consignment fees are due the 3rd of each month. The Artist / Maker receives 100% of the retail price of their artworks / products. Fees include assigned retail space, credit card fees, inventory tracking, labeling, dusting and facing.

CONSIGNMENT: The Artist / Maker hereby consigns to Strawberry General Store and Strawberry General Store accepts on consignment, those artworks / products listed on the inventory sheet provided by the Artist. Attached hereto.

CONSIGNMENT FEES & DURATION: The Artist / Maker and Strawberry General Store agree that the term of consignment for the artworks / products is month-to-month. Consignment Fee(s) are due by the 3rd of each month. Payments received between the 4th and 15th of the month will incur a 10% late fee. Payments not received by the 16th of the month will result in the artworks / products being removed from display and boxed up by Strawberry General Store. Strawberry General Store reserves the right to decline the renewal of the Monthly Consignment Agreement at any time.

DISPLAY: All artworks / products submitted shall be display ready. Artworks / products shall be displayed either by the Artist / Maker or by Strawberry General Store, and placement and display is subject to the digression of Strawberry General Store. Wall and shelf space will be assigned by Strawberry General Store.

INVENTORY: It is the responsibility of the Artist / Maker to monitor their artworks / products and keep inventory stocked as appropriate. The Artist / Maker must restock their artworks / products at least every 30 days. If artworks / products are not restocked within 30 days, Strawberry General Store will remove and box up any remaining inventory. If space permits, a new Monthly Consignment Agreement must be signed before artworks / products will be replaced in the Consignment space. The Monthly Consignment Agreement will be renewed at the discretion of Strawberry General Store.

RETAIL PRICING & TERMS OF PAYMENT: Strawberry General Store shall sell the artworks / products only at the Retail Price specified by the Artist / Maker. The Artist / Maker retains 100% of the Retail Price. Any change in the Retail Price or the addition of Strawberry General Store’s commission must be agreed to in advance by the Artist and Strawberry General Store. Payment to the Artist / Maker in the format selected in this Agreement shall be made by the 5th of the month following the month of sale.

RESPONSIBILITY FOR LOSS OR DAMAGE / INSURANCE COVERAGE: Strawberry General Store shall not be responsible for the safekeeping of consigned artworks / products while they are in its custody. Due to the Strawberry General Store’s inability to establish value of consigned artworks / products for insurance purposes, the Artist / Maker is encouraged to maintain insurance coverage at his or her discretion. Strawberry General Store assumes no liability for losses that may occur.

REPRODUCTION: The Artist / Maker reserves all rights to the reproduction of the artworks / products except as noted in writing to the contrary. Strawberry General Store assumes the right to use images of artwork / products to publicize and promote the artworks / products through social media, website and newsletters. In every instance of such use, the Artist / Maker shall be acknowledged as the creator and copyright owner of the artwork / product.

MISCELLANY: This Agreement represents the entire agreement between the Artist / Maker and Strawberry General Store. If any part of this agreement is held to be illegal, void, or unenforceable in relation to any other part: in such case, the document shall be construed as if such invalid or unenforceable provisions had not been included. A waiver of any breach of any of the provisions of this Agreement shall not be construed as a continuing waiver of other breaches of the same provision or other provisions hereof. This Agreement shall not be assigned, nor shall it inure to the benefit of the successors of Strawberry General Store, whether by operation of law or otherwise, without the prior written consent of the Artist / Maker.
